<p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>甲方（遗赠人）：</strong>姓名、性别、民族、出生日期、身份证号码、住址。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>乙方（扶养人）：</strong>姓名、性别、民族、出生日期、身份证号码、住址。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">根据《中华人民共和国民法典》第一千一百五十八条的规定，甲乙双方在平等、自愿、协商一致的基础上，就遗赠扶养事宜达成如下协议：</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>一、扶养义务</strong></p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">1. 乙方负责甲方的日常生活照料，包括但不限于饮食、起居、卫生、医疗护理等。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">2. 甲方患病时，乙方应及时送医治疗，并承担医疗费用及护理责任。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">3. 乙方应保证甲方的生活水平不低于当地居民的平均生活水平。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">4. 甲方去世后，乙方负责办理丧葬事宜，承担丧葬费用。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>二、遗赠财产</strong></p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">1. 甲方自愿将其所有的下列财产，在甲方去世后遗赠给乙方所有：</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">（1）位于[详细地址]的房屋一套，房屋所有权证号为[证号]；</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">（2）甲方在[银行名称]账户内的存款及利息，账号为[账号]；</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">（3）其他财产：[列明具体财产]。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">2. 上述遗赠财产在甲方生前仍由甲方所有、使用和处分，乙方不得干涉。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>三、协议的履行与解除</strong></p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">1. 乙方应按照本协议约定全面履行扶养义务，不得虐待、遗弃甲方。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">2. 乙方无正当理由不履行扶养义务的，甲方有权解除本协议，乙方不得主张遗赠财产。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">3. 甲方无正当理由擅自处分遗赠财产，致使乙方无法取得遗赠财产的，乙方有权解除本协议，并要求甲方偿还已支付的扶养费用。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">4. 本协议的解除，应以书面形式作出。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>四、其他事项</strong></p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">1. 本协议自双方签字之日起生效。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">2. 本协议一式两份，甲乙双方各执一份，具有同等法律效力。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">3. 本协议未尽事宜，双方可另行协商签订补充协议，补充协议与本协议具有同等法律效力。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">4. 因履行本协议发生争议的，双方应协商解决；协商不成的，可向甲方住所地人民法院提起诉讼。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"> </p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;">甲方（遗赠人）签名：__________</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;">乙方（扶养人）签名：__________</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;">日期：____年____月____日</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"> </p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>注意事项：</strong></p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">1. 遗赠扶养协议是双务、有偿合同，扶养人承担生养死葬义务，享有受遗赠权利。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">2. 遗赠扶养协议的效力优先于遗嘱继承和法定继承。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">3. 建议协议签订后办理公证，以增强法律效力。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;text-indent:2em;">4. 扶养人可以是自然人，也可以是集体所有制组织。</p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"> </p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"> </p><p style="font-family:微软雅黑;font-size:20px;line-height:1.8;"><strong>【黄林奎律师 ｜南京继承律师 南京遗产继承律师】</strong></p>
